Rental Terms and Agreement
This Rental Terms and Agreement (the "Agreement") is entered into between String Instruments and More LLC (referred to as "Provider") and the renter (referred to as "Renter"). By signing this Agreement, the Renter acknowledges and agrees to the following terms and conditions:

The Provider agrees to rent the following musical instrument to the Renter:

The instrument shall be rented to the Renter in good working condition, and the Renter acknowledges its receipt and satisfactory condition. The Renter has the right to inspect the instrument upon pick up to ensure its proper functioning and condition.

Rental Period: a. The initial lease period is for a minimum of three months, starting from the date of instrument pickup. b. After the initial lease period, the contract will automatically renew quarterly unless terminated by either party with written notice. c. If the Renter decides to keep the instrument for the entire school year, the agreed-upon Date of Return shall be the most convenient day for you between June 3rd and June 7th, 2024. The Provider will inform the Renter of the exact return schedule as soon as the date approaches.

Rental Fees: a. The Renter agrees to pay the rental fee for each quarterly period in advance. b. Rental fees are non-refundable and non-transferable. c. A valid credit card must be provided, and rental fees will be charged to the provided credit card on the agreed-upon payment due dates. d. Rental payments must be made through credit card or cash unless otherwise agreed upon in writing.

Late Fees: A late fee of $7 will be charged for any rental payments received after five days from the due date. Late fees will continue to accrue until the outstanding payment is received.

Care and Regular maintenance: a. The renter is responsible for the regular maintenance and care of the rented instrument and agrees to exercise reasonable care when handling and using the instrument. b. This includes regular cleaning, tuning, and replacing expendable items such as strings and rosin, proper storage, and following the Provider's guidelines for instrument care. c. The renter shall not intentionally cause damage to the instrument or engage in activities that may compromise its condition. d. The Renter shall not attempt to repair the instrument themselves and shall contact the Provider for any repairs needed.

Responsibility for the Instrument: The renter assumes full responsibility for the instrument and any additional accessories that may come with it. This includes covering all repair costs that result from damage caused during the rental period due to negligence, misuse, loss, or damage beyond normal wear and tear. Additionally, the renter is accountable for paying the entire retail value if the instrument or bow is damaged beyond repair, lost, stolen, or destroyed. Examples of damages include writing on the case, missing wood at the edges, pegbox cracks, broken scroll box, broken neck, soundpost cracks, and severe cracks.

Maintenance and Repairs: a. The Provider will provide routine maintenance and repairs to keep the instrument in good working condition at no additional cost to the Renter. b. Maintenance services include general checkups, cleaning, and repairs resulting from normal wear and use. The following repairs are covered: Bow rehairing, broken bridge, pegs, nut, end button, sound post setting, tailpiece, endpin, and open seams.

Exclusions: The Maintenance Agreement does not cover replacing missing parts, such as strings, rosin, or bows.

Reporting Maintenance Needs: The renter shall promptly report any issues or repairs needed for the instrument to the Provider. This includes damages, malfunctions, or any necessary adjustments. The renter can contact the Provider through phone, website form, or email to request maintenance services.

Repair Process: Upon receiving a maintenance request, the Provider will assess the required repairs and determine the appropriate course of action, and the Provider will inform of the estimated repair timeframe.

Rental Instrument Replacement: If the instrument requires extensive repairs or is temporarily unavailable due to maintenance, the Provider will make reasonable efforts to provide with a replacement instrument of similar quality and type. This is subject to availability and the discretion of the Provider.

Exchange and Early Purchase Option: a. The Renter may exchange the rented instrument for a different size or step-up instrument at any time, subject to availability. b. If the Renter wishes to purchase the instrument before the end of the agreement, they may do so, provided all payments are up to date. c. The payoff amount for early purchase will be calculated based on the remaining rental payments needed to complete the ownership requirements.

Ownership: a. The rented instrument remains the sole property of the Provider. b. The Renter shall not sell, transfer, assign, pledge, or encumber the instrument in any way until full ownership is acquired. a. If the Renter exercises the purchase option and successful completion of all required payments, the ownership of the instrument shall transfer from the Provider to the Renter. b. Upon completion of the purchase, the Provider shall provide the Renter with a bill of sale or any necessary documents to establish the transfer of ownership.

Rent-to-Own Option: a. The renter shall notify the Provider in writing of their intention to exercise the rent-to-own option. Upon exercising the option, a portion of the rental fees paid will be applied as credit towards the purchase price of the instrument. b. The purchase price shall be payable in a maximum of three equal installments, starting from the first payment due after the purchase notice is given. c. Upon completing all installments, the Renter will acquire full ownership of the instrument.

Rent Credit: Rental payments made during the rental period will be eligible for rent credit if the Renter purchases the instrument(s) through the rent-to-own option. The rent credit will be calculated as follows:

In the first year of rental, up to 100% of the total amount paid in rent can be applied as credit towards the purchase.

In the second year of rental, up to 80% of the total amount paid in rent can be applied as credit towards the purchase.

In the third year of rental, up to 60% of the total amount paid in rent can be applied as credit towards the purchase.

Rent Credit conditions: a. Rent credit is non-transferable and non-refundable. b. Rent credit must be used within 60 days of the termination or completion of the rental period. c. Any unused rent credit will be forfeited after that time. d. Rent credit cannot be used to pay for past-due rent, fees, or costs associated with delinquency or repair. e. Rental credit is calculated on base rent only and excludes the tax.

Default and Termination: a. In the event of a default by the Renter, such as non-payment or violation of any terms in this Agreement, the Provider may terminate the contract and repossess the instrument, and any accumulated rental credit may be forfeited. b. Defaulted accounts may be referred to collections or legal action, and the Renter will be responsible for any resulting costs. c. Terminating the agreement does not release the Renter from any outstanding rental or purchase obligations.

Returns and Termination: a. Either party may terminate this Agreement by providing written notice to the other party at least 07 days before the desired termination date. b. All outstanding rental fees, late fees, and damages must be settled before termination. c. In the event of termination or default, the Renter shall return the instrument to the Provider in good condition, subject to normal wear and tear. d. Termination of the agreement does not entitle the Renter to a refund of any amounts paid prior to the return of the instrument.

Additional Terms and Conditions: a. This agreement constitutes the entire agreement between the Provider and Renter and cannot be modified except in writing and signed by both parties. b. Any contact or credit card information changes must be promptly communicated to the Provider. c. Failure by either party to enforce any provision of this agreement shall not be considered a waiver of that provision or any other provision. d. If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Governing Law and Jurisdiction: a. This Agreement shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia, United States. b. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Hanover, Virginia.
